Roger Clemens Mis-Trial declared

A mis-trial has been declared in the Roger Clemens trial

Two scenarios:

#1 - Prosecutors were looking for a way out and threw the game

#2 - They are incredible idiots.

I vote for 90% #1 and 10% #2

Interesting. On the radio, Stellick paraphrased the judge as saying this is something that is beneath first year law students. A couple people have already suggested conspiracy theories and whether or not double jeopardy would come into play here.

Interesting times ahead.

Is double jeopardy valid with a mistrial? I though it was only once the case has been seen through...

I don't believe it is. While you can't be tried twice for the same action, I'm pretty sure the first trial has to reach a verdict before it can count against that.

That's what I thought too. Stellick mentioned it at lunch (not that he is a lawyer) and I thought I would ask. It would seem like a pretty stupid thing.

To be honest, it's stupid that the government is wasting their time going after Bonds/Clemens, etc.  The whole 'speak in front of Congress' was a political farce meant to further re-election bids.

I can only assume the prosecution misremembered the judges instructions..... hey, wouldnt that be grounds for appeal?

The congressional hearings were stupid no doubt.

But lying to congress was more stupid and these guys deserve to convicted of perjury.

Oh they do. This is designed as a distraction otherwise they have to go after their own.

Good for Clemens. I hate it when Stars have amazing careers then they are blemished by some sort of implications...
